    Can a POA & PR sign form 2848?

    PR was POA prior to TP death. Can PR sign form 2848 so I can obtain tax returns going back 10 years?

    Yes, the Personal Representative can request those returns. It doesn't matter whether he was POA or not. That is no longer valid. He should have some sort of document from the county/state designating him PR.

      PR should also file F56.
      Believe nothing you have not personally researched and verified.

        POA is no longer valid after death.

        Pls. see pub 559.

        If you are filing Form 56 make sure the authority is one that fits Part 1.

        Few years back I picked up a new client who was advised by some lawyer friend to file that form for her deceased brother and it got tied up for 6 months because she checked she was court appointed when she clearly was not and the will had named another sibling who had predeceased!
