    2009 Tax Return

After countless efforts to get TP to file a 2009 tax return, he chose to give me most of the tax documents but not all. The state sent an arbitrary assessment and took a nice piece of his $. I told TP let's file actual return to dispute this arbitray assessment and get most of his $ back.
Now- IRS for some reason has not caught up with him yet and I'm wondering " Should I file a 2009 Tax Return anyway?" This is predicated on him cooperating and providing the information for me to complete an accurate return.
He will owe taxes so it would be better for him to come clean so to speak and get this filed than not.
I don't know if the state would accept this filing well past the 3 year statute but since a return was never filed in the first place (much to my chagrin) what is lost here if we don't try?

    Anybody have a similar situation?
    Thanks,

    2009 return

Both the IRS and VA will except the 2009 return and process it.I would get a POA and obtain transcripts so I know of all income that has been reported.VA will adjust the money owed to the return you file.

To CYA, send a certified letter with a deadline to give you the documents that you need, otherwise this engagement stands cancelled and you are not responsible for the consequences.

This year I had a fellow that I did 2 previous years go cold on me after e-mailing me a W2 and 1099 and nothing else. E-mails and phone call went unanswered and finally on April 1, I gave him one last chance and terminated my engagement if he did not respond. Well I have not heard back so as far as I am concerned, I am done!

ATSMAN-why? Just call PPL for the third-party income statements, get the rest from the TP and file a return. When and IF the IRS questions the return, that is the time to deal with their issues.
