If not Form 8453, then what?

Disabled client got two code "1" 1099-Rs instead of correct "3," asked brokerage to change it, and got the familiar "Drop dead. We did it right, you gave us wrong information. We aren't changing it!"

Okay, I can live with that -- I made up a 5329 and killed the penalty. Now, however, I'd like to send in her IRS disability award letter to back it up and ward off future IRS attacks. I'd tack it on a paper return, but she's got a big refund -- needs it EF/DD jiffy-quick. I thought I could mail in an 8453 after acceptance, but it apparently restricts what can be sent to such useful items as a Statement of Biodiesel Reseller, Historic Preservation Certification, International Boycott Report, etc., etc.

Okay, I'm a tad biased -- there are some useful things on it (8332 for example), but still...the instructions say "Do not attach any form or document that is not shown on Form 8453 next to the checkboxes."

So...is there any EF way/form to send "feel-comfortable information" that I want on record to avoid future IRS nosing around? I know they don't care if we stress-out or not, but I do.

Frankly, I wouldn't bother unless they ask. I am not sure what they do with that stuff if there is not something in their computers which is actually looking for it.

      I would be tempted

BB, I'd be tempted to staple it to 8453 anyhow. I am anal that way.

I am so not looking forward to letters this summer where Mom claimed the child cause Dad was behind on child support. Dad already claimed, Mom's e-file rejected, so Mom paper filed. I've had two of those. I staple printout showing Dad's CS payments are deliquent, and the divorce agreement.

Come to think of it, I had one like that last year, and I've not heard a word. Reckon both parents got the benefit of the exemption and IRS isn't even checking it out?
If you loan someone $20 and never see them again, it was probably worth it.

        8453

Attach a PDF file to the original Efile return. Then no 8453 required.

I don't know how to do that.

But that's the thing, I don't want them to ask. You know the old saying -- an ounce of prevention is worth a pound of cure.

Takes about a year and a half, doesn't it? Like you said, they'll probably pop up this summer.

I'm sure they will ask, 8453 or not. The AUR computer doesn't know what's attached to the 8453....

If you send it ahead of a quiry from the IRS regarding the issue it will be ignored. If they need an explanation they will ask for one.

                Joan -- a few questions:

I know you deal in audits quite a bit, so why do you think they'll ask about it? I haven't sent a 5329 in for a long time, but I never heard anything from IRS when I did -- is it a new procedure to check all of them or have you had some recent experience with it?

                What is an AUR computer?

When you say the computer won't know what's attached, do you mean it will help, it will hurt, or it will have no effect either way?

                Thanks.

                  The 5329

The 5329 with "3" marked as the exception, (or reason, or whatever the heck they call it ) should cover it. But, you, like me, don't have any confidence that it will. I hear you, man.

Yeah, what is an AUR? Enquiring minds want to know.

                    Aur =

                    Automated Under Reporter

                    they generate those CP2000 notices.

Including the one brought in today where a 2007 form 1099 misc was posted to 2008 by the IRS..

"2007" was the biggest thing on that page....

                      Lol

Just got a new client who filed Sch C in 2007 with gross receipts $14,834. (I have his copy of the return.) Somebody at IRS entered $74,834 instead. Talk about being surprised at THAT letter...

I got one once where both the taxpayer & spouse's 1099-SSAs showed up on the CP2000 with the decimal points in the wrong place. Notice showed over a million in SS for each. All it took was a phone call; auditor & I (and the clients) got a big laugh out of that one.

Was that filed as a paper return?
