    Final 1040

    I received a package of information from a local attorney to prepare a final 1040 for a woman who passed away in February 2008. The attorney is requesting that I prepare the final 1040 and later when all the paperwork is complete the 1041. Since she died February 2008, don't I have to wait until January 2009 the complete the final 1040? In the past I always waited for final 1099s which will not be issued in this case until January 2009. I have looked several places on line and not found anything that I can file early (2008 1040 forms are not even available). I know attorneys are nice, but I don't want an argument when I tell him we will have to wait until 2009.

    Really should wait until 1) 2008 forms are printed, and 2) all the 1099 forms are received.

      Not to mention, by then we'll have a better idea what the law is for 2008.

        You don't have any choice. Cannot file early. IRS computers are not even geared up for 2008 returns yet, and won't be until Jan 2009 (or later as what happened in this year, depending on what Congress does.)
