    Canadian distribution

Canadian citizen is now living in the US. After moving to US, he closed out the Canadian equivalent of the 401k. This is called an RRSP or RSP.

Anyone familiar with this and how to report it? Probably L21?

    Thank you,

    D

Publication 597 Info about U.S.-Canada Income Tax Treaty

One publication that seems to be pertinent is IRS Publication #597, "Information About the U.S.-Canada Income Tax Treaty". There is, among other information, a section entitled "Pensions, ..."

Also, one should ask when this person who isn't a U.S. citizen may have satisfied the substantial presence test, or the green card test, to become a U.S. resident noncitizen. We need to understand whether this person may be required to file a 1040NR, or a 1040, or is a dual-status alien for the tax year in question. Publication #519, which is entitled "Tax Guide for NonCitizens", covers the rules which apply. If a 1040NR is called for, see also the instructions to that form.

        Solomon and Otis

Thank you both. I will check the form and pub out. I did find out about 8891 last night, but did not have a chance to look at it.

        Thanks again,
