How to handle these visa costs?

Company is spending $3600.00 to a company for H2B visa

PURPOSE: to bring back workers "legally" to obtain a work visa.

I think this would be a Accounts Receivable for the company (loan to these employees) - would you agree?

Do the employees agree to reimburse the employer for the cost? Is the reimbursement contingent upon them actually getting the VISA? Are there loan documents signed with these potential employees?

after posting I then realized - how does a company who spends money on a "head hunter" to find employees handle that cost ?

My impression is that this is not a loan. This is a company that lost its employees due to them being illegal aliens. The company now wants to try to get them back through legal channels.

The question should really be centered on whether or not this is an ordinary and necessary business deduction. Is it ordinary and necessary to recruit workers from a foreign country?

Our nation is founded on immigrants who came to this country to work after reading ads for jobs in the “new world.” So I would say, yes, there is good history behind recruiting foreign workers.

turns out that there is a company out west that handles the legal recruiting of immigrant workers to ensure proper green cards (visa), etc. due to the type of work.
