    1040X and stimulus check

    Hi

    I had to file a 1040X form to correct an issue with my 1040 form. Instead of me owing money to the IRS I would now get a refund. However I got my stimulus check before the 1040X was completed by the IRS and they reduced the amount of the stimulus check by the amount they thought I owed them.

    Is there any way to get back the amount removed from the stimulus check that I would have gotten once the 1040X is completed??

    There is a way,

    if the amount was not for a debt collectible by the IRS.

      1040x

      You'll get your refund with your 1040X. Make sure you include everything you paid with your original return and after filing (what was used from your stimulus payment) on the correct line, so you get your true refund for your amended return.

        I'm confused...the 1040X was already filed...weeks ago....the stimulus check just showed up yesterday. So unless the IRS people doing the 1040X somehow are notified that I didnt get the full amount in the stimulus check they will probably just send back to me what I should have gotten with the original 1040.

        Or are you saying I should file another 1040X?

        I tried calling them but the stimulus lines have been tied up for weeks....it even hangs up on me saying they are overloaded.

          I'm very glad to hear this. I am weary of Stimulus Package questions myself.

          Will your situation be very different for 08? If not you'll get the rest next year.

              Next Year

              Sorry, thought you had not completed 1040X, didn't read that the IRS had not completed processing 1040X. When your refund arrives, you'll know for sure, but expect that you'll receive what the X asked for. Maybe the computers check what's really been paid on your account, but doubt it since paper entries won't have been entered yet. But, you have another chance next year. Or, you can file another 1040X with the new information you have, but is it worth it?

                You do know that I was talking about the IRS having problems in handling the calls. I understand your frustration and wouldn't want you to suffer at their hands.

                The advance refund is based upon the amount that would have been allowed as a credit under Section 6428 if that credit had applied for 2007. Any advance refund paid to the taxpayer will reduce the Section 6428 credit that is allowed for 2008, but not below zero.

                  Please accept my apologies JG.....its been a real bad few years for us...and this year is has not been good. First we get a letter from a big investment firm that my wife's SS# and name had been stolen and we should freeze her credit line. Which creates a massive mess. Then we get the check in with alot less money in it. We're dealing with it...but it gets trying..... Again sorry...
