    E-file for deceased taxpayer

    Father/Daughter, daughter is personal rep appointed in will(not by court) for father deceased April 2008. Can a return be efiled for a deceased taxpayer?

    Form 1310 through proseries program will mark and allow the efile on signature line prints "Proof of Death Previously Filed", but how do I file proof of death?

    Instructions say to file form 1310 with return, so can I file this by itself and efile the return or do I need to file it with a paper return?

    Proof of death is usually a death certificate prepared by the attending physician. Your client should have, or should have requested a dozen of these.

    If you efile the return, you would have to send the certificate with 8453, so you might just as well mail the whole thing.

      Jesse, I had the same situation but don't see the text printed on signature line. I also use ProSeries. Are you talking about form 8879 or form 1310?

        Form 1310

        If you look at From 8453 you will see that attachments for Form 1310 are not one of the options so I believe paper filing is a must in this siutation.

          Form 1310 - If you check B or C you can then check the box to have "Certificate Previously Filed" print or box C "Proof of Death Previously Filed" pint at the bottom of form 1310. Did you efile or paper mail?

          The instructions for Form 1310 state to NOT attach the death certificate or other proof of death, instead keep it for your records and provide it if requested. Form 1310 is eligible for efiling according to IRS instructions, just not sure how to do it?

          I do see it is not a specific form listed on Form 8453 so I think I'll have client sign form 2848 and send with Form 1310.

            E-file for Deceased Taxpayer

            I had a case this tax season of a married couple - ages 101 and 100 (seriously-no joke) -
            Husband died 4/1/08. Son had POA for mother.
            Tax return noted husband deceased 4/1 (no fooling), son signed Form 8879 for his mother Filing as Surviving spouse.

              Form 1310

              I have efiled a couple of these returns, No Will or Court Appointment, just a personal representative, with no problems.

              On the form 1310, if you check the personal rep/other person box C, you should be able to efile and use form 8879 and then you can provide direct deposit to the personal rep bank account.

              IRS has never come back and requested a copy of the death certificate or proof of death, and the funds have been direct deposited into the Pers Rep bank account. In fact this year the Pers Rep even received the Stimulus Rebate via direct deposit in May.

                I have done the e-file the same way Sandy has. Got a little bit concerned after your post, Jesse. I don't think any box (B1 or C1 in ProSeries) needs to be checked if the documents haven't been mailed. I believe you need to have proof of death on file in case IRS wants to see.
