    CalPERS

    CalPERS is a mandatory contribution for all county employees , there are some that feel it qualifies for Form 8880 credit. Anyone have any thought on it.

    The contributions come out in Box 14 form W-2 as pers TD.

    The county employees union say's it qualifies for the credit. The county does not think it qualifies. Bottom line is no one knows for sure.

    The code says contributions have to be "voluntary" and "elective", and I don't think PERS contributions would meet either of those requirements for the retirement credit. And in some cases the employees contribution is paid by the employer anyway.

      Not the ones in box 14.

      Correct, the instructions for 8880 say the types of plans that work for this credit and that these are in box 12 of your W-3.
