    Injured Spouse and Stimulus Payment

    I filed MFJ for couple for 2007. Wife did not want to file an Injured Spouse at that time. She wanted refund to go to pay off LARGE debt owed by husband.

    Now she wants to file an Injured Spouse to get her share of the Stimulus payment. Do you think this will work? I think the Injured Spouse form and stimulus payment will cross. The payment will be applied to the debt. Do you think the IRS will go back and take her share of the payment off the debt and send it to her?

    I'm not sure any of the refund from the original return will be applied to her because she has a loss on her Sch C and all withholding is from the husband. I told her that the IRS will make that determination. She wants to do the injured spouse just for the stimulus payment.

    I have no idea

    But I do find it interesting how clients expect us to know every detail of this one-off program. The last time we had a tax rebate was when Nixon bought his second term with one.

    I do agree that since she had no withholding she was entitled to none of the refund unless she had a child from a previous relationship that she was entitled to claim and her husband was not. In that case she might get the child tax credit.

        Well, see I'm not sure if she would get any of the refund if she filed the Injured Spouse. We are in a community property state and the IRS might do a community property split to figure her share of refund. The one child on the return is her from a previous relationship.

        Maybe I should call the psychic network. They can tell me!!!!!

          Well when you do, and they ask for your name and credit card number, you can
          tell them that they MUST already KNOW that! right? (grin

              She will qualify because she filed joint with the husband and the stimulus is based on the total of the income on the return. At least that's how I understand it.

              I'll just explain what I think will happen if she files the Injured Spouse and let her decide.

                In that case, I'll tell the client to call them. They can give their credit card.
