    Death of Client

    I have a couple that I am working with where the man died yesterday. They were to sign the 8879 today. Can she sign for him? Do I need to do the 1310 form? and report him as deceased on the date of death? I think I know what has to be done but need some reinforcement from others. Can the returns be efiled?

    I encountered two situations last tax season where one spouse died before the return was submitted. In both cases I just told the surviving spouse not to worry about anything and I filed extensions for them. Then we took care of the taxes several months later when the spouse was under less pressure. They were very appreciative for the relief. Plus, they both had tax-related questions going forward that we could deal with after they had a chance to reflect and think about things more clearly.

      Yes you can e-file, have her sign (Filing as Surviving Spouse), you wouldn't need
      an 1310 form.

        I did one of these about a week ago, just as Gene described.

        Only in government or politics is a "cut in spending" really an increase. It's just not as much of an increase as they wanted it to be, therefore a "cut".
