    How to resolve this?

    Previous preparer failed to claim dependent children and child tax credits on taxpayer’s returns for several years. Taxpayer can not find his copy of the 2004 return and the previous preparer has not complied with his request for a copy. Time is fast running out to amend the 2004 year. Any suggestions to resolve this issue? I did find a 2004 vs 2005 comparison worksheet with his 2005 return which does give me enough data to complete the 1040X except for the actual tax calculation that was used on the original return since the tax shown on the comparison worksheet was not computed using regular tax tables. Can I file the 1040X without a copy of the original 2004 return in order to meet the filing deadline? Would this be considered a valid 1040X filing? Get a copy from the IRS later?

    Another Option

    I don't know the exact answer to your question, but another option could be to file a POA for the client. Then you can download the return info from the IRS site and you will know exactly where things stand.

    Only in government or politics is a "cut in spending" really an increase. It's just not as much of an increase as they wanted it to be, therefore a "cut".

      If the 1040X doesn't match the original figures exactly, it will be rejected. Also, you have little time. The return, because it is amended, has to be Received by the IRS by Apr 15. This means either is means either overnighting it by Mon walking it into an IRS office on Tues.

      The client, or you with a POA, can request a Return Transcript be faxed to you. You will be able to take the numbers off of it.
