    1099 Misc

    A self-employed truck driver wants to file taxes, issued a 1099misc to an employee but did not send a copy to the IRS, what are the consequences for that and can he still report that on Schedule C in box 11 and send a copy to the IRS asap?? Will he pay penalties for that. Where can I find this info for employers?

    Go to www.irs.gov
    Get the instructions for 1099MISC.

    There may be a late fee. Also, employees should get a W-2, not a 1099MISC, but a lot of people dodge the matching SS & MCare by using 1099s for employees.

      thank you I did go to the irs website immediately after I posted this message, and found the info, you are correct about the W-2 I should have put sub contractor and not an employee.
