    W2 box 12 doesn't show employer HSA contribution

    I have a question that I should know the answer to, but unfortunately I don't. A client has an HSA to which employer contributed in 2007, however, the W2 box 12 doesn't show any employer contribution. The client's statement from the bank says the employer contributed $175 in 2007. The software that I use (Intellitax) will not let me enter the value directly on line 9 of form 8889 without overiding that line. If I do that, I can't efile the return. To do it correctly the way the software requires, I must enter a value in the W2 box 12 entry form with code W. The amount then flows through to line 9 of 8889. Is it okay to place a value in box 12 even if the client's W2 box 12 is empty? I'm afraid I can't put anything in this field if the W2 doesn't show anything. Am I correct or way wrong? Any help will be appreciated.

    I have done it that way, but that doesn't make it correct so maybe someone else will jump in.

    We have a couple larger employers in the area that don't report the HSA correctly on the W-2 and by coding the W-2 w/ the W Proseries does the Wisconsin Schedule I adjustment.

      I've been in the same boat. Taxwise actually lets me force it in form 8889.

          Included in Wages?

          Can you tell whether the $175 is included in wages or not? If not, then it appears to me to be a "wash."

            The $175 wasn't included in wages. The employee contributed an additional amount after taxes where withheld.

              Hmm, doesn't seem to stop me from efiling when I do an override there. Shows that I have an override when I look at review return but nothing that prevents the return from wrapping.

                David1980, so are you saying that I should be able to efile this return even with an overide? I talked to the tech support and they said that I couldn't.

                  I think support in general try to tell customers not to override because 9 times out of 10 an override means something isn't right. Unless there's an IRS rejection for a mismatch of line 9 of the form to box 12 of the W2 it would go through I believe.

                  If you did send it, and there was an IRS rejection code for this, it would simply reject from IRS. So I don't see any harm in trying?
