    Stimulus Payment [Deceased Taxpayer]

    Taxpayer died way back in September, 2006.

    Adult son never informed the social security administration. He has been cashing and spending the social security checks ever since, and has now received Form SSA-1099 for his deceased father.

    The total social security benefits received during 2007 exceed $3000.

    Is the deceased taxpayer eligible to file a tax return in order to receive the stimulus payment?

    My client is the deceased taxpayer--not his son. I have been retained by an attorney who has been appointed to administer the estate. Yes, the estate is still open, because the son also did not... well, never mind. That's another story.

    Well, the opposite happened happened to a client of mine. Someone made a mistake and reported her as dead. For over a year she didn't receive any social security and couldn't access her bank accounts since she had to proof that she is still alive.

    I am not kidding. It almost destroyed her.
