    Bees Question about Protective Extenison

    So I file a prtoective claim and Fisher wins. I can't imagine the IRS then processes the 1040 X. I assume I have to send in another 1040X referencing the first one.
    Do you agree?

    I guess it depends upon whether or not IRS processes the 1040X and denies your request for a refund. You would then have a basis after Fisher wins to go back, file a second 1040X, attach the first that was rejected proving you filed on time, and say, give me my money.

    If IRS just sits on the 1040X and waits to see if Fisher wins, then I would think that first 1040X would be all you need to do assuming they do in fact eventually process the return in light of Fisher winning.

    I really don't know whether or not they are just sitting on all of these 1040X's, or whether they are rejecting them.
