    The Very First

    A woman came in my office done her taxes and said" I will take the refund and have a sex change." She was to go home and write a Dear John to her husband, which is out of town, saying just that. Her name is Jan and next year it will be Dan.

    My fear is the husband might just call or come on his refund too! This has been a wild ride this year and pray for April 16th!!!

    Should I ask that hunter/fisherman for one of his guns?

        I hope she/he does not come back as Dan. It was bad enough as Jan. But I am concerned about a husband that is coming back into town with no wife AND no refund!! Wife I don't care REFUND is my worry. Maybe he want care.

          Right. Maybe he will be glad to be rid of him/her and that is an easy payoff. Lets hope for the best.

            Just curious....suppose he got a sex change tooooo...and they decided to remain married.....

            If you listed him as the taxpayer and her as the spouse...would you need to reverse the order on the return when he turns to she and she turns into he?

              She told me she was coming back as Dan and do hers/his alone. I don't ever want to see that person again. Glad she told me after I finished and got my money or I would not have been able to do hers.

                How would this change of gender be treated by the IRS? What are the ramification of The Defence of Marriage Act [1996], signed by that legendary defender of family values, William J Clinton?

                  I guess this means your client might present you with a long list of clothing donations ("I paid a lot for those" ?) next year.

                    Haven't seen mine yet this year that was half way through the change last year - him to her. Always came in with male "friend". Of course I might not reconize "him".

                      I have a male pre-op TS client that owns a hair salon, that also is a popular, local performer in a 'drag show' in a local club that caters to such an audience..

                      Foxxie claims her tips from the performances, and deducts clothing, makeup, etc as expenses... s/he asked me about when s/he has her final surgery- and I had to break the news to her that her costumes, would no longer be costumes, hence no longer deductible.

                      Her mascara ran terribly, as she cried...

                        I have clients that stayed married after he had a sex change into a her. It would actually have been quite beneficial if the marriage was nullified for tax purposes, (because they filed MFS, and single would be much better). I researched it, and it was not.

                        I'll take your transgendered clients, SueBaby. We don't trip on such things here in CA.

                          Will she take a medical exp deduction for it?

                          Nex year she/he will probably deduct the cost as a medical expense as a corrective surgery proceducre designed to correct her gender.

                            Under federal law, a marriage can only be between and man and a woman. If he legally became a woman, they could no longer be considered married for federal tax purposes [Public Law 104-199]. However, I doubt the federal law specifies what happens in a sex change operation. I suppose it depends on whether the name and sex of the individual is changed with Social Security.
