Granddaughter, grandma, and boyfriend

    Granddaughter, grandma, and boyfriend

    All three live in same household for entire year. Boyfriend provides more than 1/2 of support. Grandmother is disabled and only receives SS. Grandaughter is still in school. Can the boyfriend claim the granddaughter as his dependent, (qualifying relative) since the grandmother has no income and is not filing a tax return?

    Whose boyfriend is he? Grandmothers, granddaughters or is the mom in the picture?

      Whose house?

      If it's grandma's house, she IS providing some significant amount of support to her offspring.....the old 50% thingie!

          Sounds like an interesting living arrangement, to say the least.

          Wonder if Granny is getting paid for babysitting et al??

            Can't grandma's boyfriend claim girl as qualifying relative since grandma isn't filing and doesn't need to?

                Re original question: sure, why not, as long as granddaughter meets the gross income test.

                PS some people (IRS ?) would say that g'daughter was a qualifying child of g'ma even tho g'ma was not filing

                  They actually changed that this year. See IRS Publication 501 page 13 top right of page "Child of person not required to file a return." So in this case if Grandma doesn't file a return and isn't required to file a return boyfriend can claim the granddaughter.
