    Employer Provided Health Insurance

    Is is OK for an employer to provide health insurance to only select employees? I'm thinking not but am not 100%. I believe that they need to set eligbility and then any employees who are or become eligible must be covered if they opt in? Is this correct?

    Under Federal tax law, a Section 105(b) plan that reimburses the employee for medical costs including insurance paid by the employee cannot discriminate. Under Section 106 where the employer pays the health insurance premiums, there is no rule preventing the employer from discriminating.
