I have a client working fulltime during the day and a volunteer fire fighter at night. He does receive a small W-2 from the fire fighting. The taxbook says mileage between home and 2nd job is never deductible on a day off. So does that mean that mileage would be deductible when he goes on on fire calls at night when he worked all day at the first job? Of course we still have the 2% limitation of AGI but got caught up in the wording of this.

Here is what I am going to do. Mileage between job1 and the firehall will be deductible as biz mileage. Mileage between home the the fire hall will be charitable mileage. This fireman does get paid a stipend but it is so low that he is considered a volunteer. In any case the mileage is peanuts but the taxpayer is making a big deal of this.
