    Dependents Again

    According TTB a qualifying child under 24 (college) there is no income limit as long as the support test is met, child less than half self support. Then the parent can claim the child as a dependent...??

    Is that correct????

    That is correct.

    1. The child must be your son, daughter, stepchild, foster
    child, brother, sister, half brother, half sister, stepbrother,
    stepsister, or a descendant of any of them.
    2. The child must be (a) under age 19 at the end of the year,
    (b) under age 24 at the end of the year and a full-time
    student, or (c) any age if permanently and totally disabled.

    3. The child must have lived with you for more than half of
    the year.2
    4. The child must not have provided more than half of his or
    her own support for the year.
    5. If the child meets the rules to be a qualifying child of more
    than one person, you must be the person entitled to claim
    the child as a qualifying child.

      That is true under the qualifying child test.

      Under the qualifying relative test (which could still be your child), the relative’s gross income must be less than $3,400.

        I had a 17 year old come in today that earned 12,000+. So I setup the return for the parents to take his dependency. As he was leaving I learned that he dropped out of high school for a 1-1/2 and is now back in high school. He was still living at home all this time. And dumb me, it didn't register to me that he may not be a dependent and I didn't question any support issues ($12,000 W-2 should of triggered support/savings questions).

        I hate the beggining of tax season. He should come in on March 31.

        So now I have to call him back to check on when he started back at HS to see if he was a 5 month student and look at support issues. Otherwise he can claim himself and his parents can't.

          Bob,
          Since he is under 19, he doesn't have to be a student, as long as he doesn't pay
          over 50% of his own support, he would qualify as parents dependent.
