    I Forgot Signature!!!!!

    I had a client yesterday that did a paper return. I had her sign her state and forgot to have her sign her federal. The preparer info was printed on their though. I realized my mistake soon after she left but by the time I finally reached her last night she had already taken the unsigned return to the Post Office. What do I do????

    Nothing >> she will get the return back for signature.

      Thanks!!! I sent her a letter apologizing and offered to do her next year's return for free, then if I lose her, I'm not out anything!

        I just reread your post and it was YOUR signature missing. You are not required to sign the return if your name is printed in the signature block...

        I would never give a client a free ride for that mistake..................

          Client Forgot to Sign

          She will probably not get the return back, but the IRS has a form that they usually send that tells them they forgot to sign, and asks them to sign the form, which they will associate with the return...It happen to a client of mine who I filed numerous late returns for, and I mailed it to him with flags all over, and he still forgot...I know because I had his POA and got a copy of the notice to him to sign...

            You are right> NYS sends the whole return back...............

              I always put a "sign here" flag on the return. That reminds me to tell them to sign it. Then it's their problem.

                I always include a letter of instructions, which tells them what their refunds are / and or balance due. Something about preparing their return based on information they provided to me. Something about please review the return carefully. Something about after reviewing the return, sign, date, and mail the efile authorization form back to me, or sign, date, and mail their paper return in the attached envelope. And something about how to pay any balance due.

                The form letter is something I do for every client, even if they come in to pick up their return. That way they are always notified in writing what their responsibility is. Even if you tell them what to do in person, you have a written record years later that proves what you told them.

                I had a client recently who said he got a letter from IRS asking why he hadn't filed his last 5 years worth of S corp returns. Apparently he forgot to mail all the returns I sent him. I pull out my file with a copy of the letter I sent him telling him to sign, date, and mail his S corp returns. I'm off the hook. It’s not my fault he failed to look at the letter and didn't mail his S corp returns.

                  I have taken on the responsibility of E-filing all Fed & State Corporate tax returns, just to save my client that error. With the new Federal penalties that would mean BIG penalties in the future. NYS has always charged Big fees ( not as bad a CA),

                    BOB W do you e-file NYS Corp?

                    I thought only Federal Corporations could be e-filed?

                      NYS opened Corp efile last year even ARCH Debit for taxes.
