    Education Credit.

    Client has been a college student for the past 2 years. She obtained legal status in june 2007.Her father has been a legal resident for over 5 years.
    The question is ; can he claim the education credit for his dependent daughter. I am almost sure he cannot because she was not a legal resident for the entire year.
    The tax book only mentioned tax payer and spouse.

    What I found

    The daughter has to be a dependent, at some time during the year, to claim the tuition as a deduction or credit.
    So the daughter has to be a citizen or a resident o fthe US.
    Or a resident fo Canada or Mexico.

      Kram, does the daughter have to be a legal resident for the entire year.

        Waht I found

        In Lasser's the wording was she has to be a resident for some part of the year. So if she became a resident on or before Dec 31 it would seem you are all set to calim the credit.
        I will say, in TTB and in the IRS 1040 instructions there is no clarity on this point.
