    What to do when not a rental

    My client owns a house. It was rented for only 3 one week periods in 2007. He spent hundreds of hours fixing it up in 2007. It was used personally for more than 14 days.
    So it is not a rental for passive activity rules as explained in TTB page 7-12 and 7-11.
    So do I report the 3 weeks income, and deductions up to income on Schedule C? Or do I do something else?

    but I think wrong place. Income on line 21, but deductions on schedule a.

      Would it not be divided between Schedule E and Schedule A? Divide the portion of expenses between personal and rental? Report rental income on Schedule E. Expenses would be limited to gross income from rental.

          There was a discussion on this not to long ago and if I remember correctly> a not for profit rental gets reported on line 21 and schedule A (taxes and mortgage only).

          So the question now is> was this a "for profit" endevor? If so Schedule E is the form to use.

          Now we seem to have "mixed use" property and I don't remember that outcome............

            Available for rent?

            Was the property available for rent during the whole year? Or was he fixing it up and only had it available toward the end of the year?

            If it was available for rent but not rented, I don't think the expenses are limited.

            But if he was doing major work, some of it might have to be depreciated and not expensed.
