Demutualization and Fisher Case

Does anyone know the status of the Fisher Case having to do with the basis of stock received when insurance companies demutualized? I would have thought a decision would have come down by now.

In my tax update seminar last week, Andy Biebl said the Supreme had just hear the case and he expected a decision to be released in January. He advised filing protective claims if the amount was significant.
