    Tax Free Tobacco

I recently read that the Seneca Indian nation sells tobacco across the country and is not required to report the sales to any state because of a treaty?

    Oklahoma's Cigarette Tax

had a whopping increase in 2006. almost $10 per carton just in tax alone.

State suffered huge revenue declines. Smokers just went to Indian Reservations and bought their smokes.

Smokers are just addicted -- they ain't stupid.

        Tax free cigarettes

North Carolina used to have no state tax on cigarettes. I used to buy several cartons when I passed through North Carolina. I save even more now after having kicked the habit.

          Not quite ...

Members of the Iroquois Confederation, including the Seneca Nation, operate many stores and casinos here in Upstate New York, both on original tribal lands covered by treaty, and on lands purchased by the Nations. There have been many court cases with respect to taxes, as well as to ownership of the lands themselves. The current court decisions seems to confirm that the Nations are exempt from property taxes, but that sales to non-members of the Nation are subject to NY sales tax. New York State however, has not enforced collection of the sales tax, in spite of suits successfully brought against the state to force it to do so. Various deadlines have been set for collection, but have passed without incident. The governor has very recently removed the sales tax revenue from his projected budget.
