    1040X for changing dependents

    Wife filed and claimed son. Ex now wants her to amend and claim daughter instead, so he can claim son and take education expenses. She says the divorce decree doesn't state who takes which child. Is this change as simple as amending and changing the dependent on 1040X p 2?? There will be no tax change.

    Essentially, yes. Ask the wife to fill out form 8332, releasing her right to claim the exemption for the daughter for the year in question, and attach the form to the 1040X.

      Why didn't the wife claim the education expenses if she was claiming the daughter?

        Wife claimed son initially. Son has the education expenses, pd for by Dad/Ex. Ex wants wife to claim daughter instead. I'm attach the additional release form as suggested. Thanks!

          Sorry for the confusion.
          If wife originally claimed son, and son has the education expenses - why didn't wife claim the education expenses along with the exemption?

            If we're talking about the deduction rather than a credit, Dad is the only TP that can take it and only if son is claimed. The rules are different regardless of what your software calculates.
