    Form 8594 Asset Acquisition - no EIN

    Client sold his business (SMLLC). I'm working on completing Form 8594. We do not have the buyer's social security number or EIN. Can we paperfile the return and write "buyer refused to provide" or similar in the box for identification number?

    Buyer is being unresponsive to our requests for a copy of Form 8594 as they filed it or seller's request for buyer's identification number.

    TTB page 25-2 says the penalty is $50 for failing to file Form 8594. Big whoop-de-do.

    I wouldn't worry about it. Fill in what you can and say buyer is being a jerk about it. Let IRS do what it has to do. All they can do to you is ask for $50 bucks.
