Past due State taxes....

    Past due State taxes....

    My wife and I had to move abruptly in 2004. From MI to SC (for a family matter). We were renting in SC....while still thinking that MI would be our main address and we would be moving back ASAP .....

    We foolishly didn't file our state taxes for 2004, 2005, and not yet now for 2006 - We have filed all our Federal Taxes......we just weren't sure exactly where to file our State taxes....be that MI or SC.

    We now know we will have to be staying in SC for the forseeable future. We have all our tax information ready to be submitted.

    Can I have any advice on how I should go about filing. It was foolishness on my part for this situation (not having filed properly). I want to remedy the situation but am also concerned about what troubles I will likely have now.

    Just looking for advice on going about filing past due taxes.

    Our standard reply....

    ..... is "You should see a local professinal". But I will say, The year of your move requires two part year resident returns. One for MI and one for SC.

    There could be other issues, too many to get into here, as another reason why you should see a local professional.

      Filing SC Returns

      You could go to one of the SC Dept of Revenue offices and fess up. I am sure they will work with you. You are not the first to have done this. However, I would hire a tax pro in SC who will look at for your own good. The TaxPro will be the best money you will ever spend for a situation like this.
      I am a native of SC but now live in south Florida. Good luck.
      Oh by the way go to the NATP website and select a preparer in the town where you live.

        A good site to find a tax pro to help is the South Carolina Enrolled Agents website.

        Only in government or politics is a "cut in spending" really an increase. It's just not as much of an increase as they wanted it to be, therefore a "cut".

          Check the NAEA website NAEA.org which is the National Association of Enrolled Agents, and then check the South Carolina Enrolled Agents http://www.scsea.org/.

          They have member's list that you can contact in your area. Most can prepare dual state returns.

            Thanks for the advice / tips - (to everyone).

            I plan to go meet with a professional later today......

            My wife is concenered over "jail" and things of this nature. Can I ask, would it be wise for me to assure her that is not going to happen....

            Thanks again......Together we make under $39,000.

              Jail?????

              Nobody goes to jail for this. If you are getting a refund, you will just get your refund and nothing else. If you owe, your will pay penalties and interest.

              Just get your filings up-to-date and everybody will be happy. Good Luck............

                The first issue you must address is when you ceased being Michigan residents, and started being South Carolina residents. From your post, my guess is that you are retired and your income is not from wages, but from pensions and investments. Each state has its own quirks about when residency is established and how long a nonresident can be physically present before paying income tax. The tax collection agencies for both states probably have more information on this on their websites.
