    Dependent fileing MFS

    Telephone call today.
    Boy 23 full time student in 2006 marries late in year. Both wish to file
    MFS however the girl tried to file on line and the return was rejected.
    Reason: Some one had claimed one of them as a dependent. I believe both are
    working but they want to know how to file. I have no more info, any suggestions?

    Happens too often

    I've had parents try to claim the child, "I supported them until December so I can claim them." Only thing your clients can do is file paper returns, MFS if that's what they want, and let the IRS tell mom that she is cannot claim the kid. It will likely hold up any refund(s) but it's the right thing to do. I avoid arguing with the parents, let the mean, rude IRS do the dirty work.

    You probably know the parent can claim the child IF neither of the newly weds have a tax if they filed MFS (IOW, neither one can have much income).

      Thanks for the confirmation, that was what I told him on the phone, Sometimes it is
      good to have a little backup. Thanks much.
