    IRS Letter and Amending

    Client received letter from IRS for 05 return. IRS is looking for Sch D transaction on taxpayer's return. They were MFS and it was all reported on the spouses return. I am going to amend the returns anyways and change them from MFS to MFJ to claim tuition that was paid for their daughter. My question, can I amend the return and answer the IRS letter all in one step, or should I answer the letter explaining that the transaction was reported on the spouse's return, and then file the amendment later?

    Answer the IRS Letter

    and then file the 1040X when you have time. You might indicate that a 1040X is forthcoming.

      Actually, I do it the other way around. Do the amendment, mail it separately to appropriate
      address (Atlanta), and then answer the letter telling them what's been done.

      IOW, I answer the letter with a fait accompli.
