    Extension file for deceased parent

    Parent just passed a few weeks ago and the children can not find the will mother never told them where it was. Daughter just contancted me in regards to filing an extension for this year so they have more time. Question Can the daughter sign the extension even though none of the children have POW? Mother normally owed at the end of every yr and they do not want to get penlized. Thanks for our help.

    There is no such thing as a power of attorney for a dead person, so don't let that stop you. First, determine if probate is required--make a rough estimate of the assets that are not already held jointly with an heir, and call your county probate court. If probate is required, you can't do much until the court appoints an executor or personal representative.

    If probate is not required, anyone in constructive receipt of the assets can file the return. As for filing the extension, you can do that for her yourself. No signature is required.
