    Different set of PA questions

    I'm in CT. Son in PA hasn't done his 2005 taxes yet due to a missing W-2 (or lack of interest). In 2004 he lived with his dad in Sanatoga, PA, and worked in Sanatoga and Philadelphia while attending Temple University. He moved into a Philadelphia apartment in the middle of the fall of 2004, but it was for six months until graduation; so think his tax preparer considered it temporary and used Sanatoga as his residence all year in 2004.

    Now, for 2005: He was still in the Philadelphia apartment for two months, then he backpacked through Europe for two months, then he worked a seasonal job on Martha's Vineyard, MA, for five months, then he returned to his dad's house in Sanatoga and spent time at the Inn at Starlight Lake where his girlfriend is the executive chef (in my other PA thread), and finally moved into a house she bought in Lakewood in December, about the 25th. Can I make it easy for myself and consider his permanent residence for 2005 still his father's house in Sanatoga, PA, for the whole year and all his other stops as temporary for college and summer job and travel?

    Still missing a W-2, but think he worked in Philadelphia, maybe Sanatoga, Martha's Vineyard, and maybe Starlight during 2005. So, what will I need in the way of local returns? Can I use the generic PA local return in ATX? Is there a website where I can look up tax rates to use? Anything else I need to know or to consider or to ask him?

    (In 2006, he lived all year in Lakewood. He worked in Starlight, PA, and Hancock, NY.)

    Thank you very much for any and all help. Now that they're settled, a bit, I need to learn this PA stuff. Although, she made only a two-year commitment to her job, and that's up this fall.... Wonder what state they'll live in and/or work in next!!!

    It would be much easier to treat his home as Sanatoga, PA and file the local taxes there. The township for there is Lower Pottsgrove Twp and the school distict is Pottsgrove. Berkheimer Associates collects the 1% local tax there. Go to their website and download the form http://www.hab-inc.com/content/downloadforms.htm They do not like generic forms, so you will have to download and fill out one by hand.

    Since this is a 2005 return, there is a fair chance that Berkheimer may issue a penalty for not filing or just refuse to send a refund if he is due one.

      Just to add on to the good info supplied by KBTS, if you'll treat him as a PA resident, and resident of Sanatoga all year, and if he had Phila wage tax w/h, that is treated as a credit on his Berkheimer local return. Also, if he had MA tax w/h, you may need a MA non-resident return. PA state will credit the lesser of tax paid to MA, or PA tax liability on income earned outside PA. If MA tax is higher, the amount over PA rate is a credit on the local return.
