    Divorce and Rental Property

    Client is in middle of a messy divorce. (Is there another kind?) She and her soon to be EX own several rental properties. She wants to file HOH claiming the child who has lived with her apart from the husband for all of 2006.

    Husband is refusing to allow her any of the information on the rentals and has not allowed her use of any of the funds from the rents. His attorney tells her the judge will force her to file joint with him promising to “share” the refund. She is the only one who works and has withholding tax and will do quite well filing as HOH.

    My questions, Can she file without the rental information since she has been denied access to the money and information needed to file? Also, Has anyone ever heard of a judge forcing someone to file joint? I thought every person had the right to use any legal filing status.
    In other words, a democratic government is the only one in which those who vote for a tax can escape the obligation to pay it.

      Her attorney can't understand why she doesn't want to file MFJ. I've met with her and she doesn't seem to understand taxes very well.

      Husband has let units set empty instead of cleaning them up to rent to drive the rental income down to avoid support payments. Meanwhile she (my client) is working two jobs to survive. His attorney says "look she make plenty and doesn't need child support".
