    Does the state of Maine recognize the Federal exclusion of gain on the sale of a personal residence? Also, does it make any difference if the taxpayer is a nonresident of Maine at the time of sale?

    Sale of personal residence

    Maine conforms to the federal rules regarding the exclusion of gain on the sale of a personal residence. It does not matter whether the taxpayer is a resident or a nonresident at the time of sale. Maine Code Sections 5121 and 5122.
