Send 1099MISC to an LLC?

    Send 1099MISC to an LLC?

    We all know that you do not have to send a 1099MISC to a Corp. How about a LLC?

    I send 1099's to all LLC's, they are not a corporation even though many lawyers refer to them as "Limited Liability Corporations". A plumber in our area has a fit when he receives his in the mail, but I don't see what the big deal is because he needs to claim the income. I THINK, but am not positive, it depends on how the state recognizes the LLC formation.

      .... I issues LLCs 1099s. Since an LLC can be disregarded or a partnership, they get one. But an LLC can be a corporation and I'm just not going to go through the trouble to find out if the LLC is a corporation or not, so they all get one.

      I treat them according to their tax "election" and the related IRS guidelines

        I also issue to LLCs. I see them as Limited Liability Companies, not Corporations. Besides it doesn't hurt to send one if you don't need to, so why not error on the side of caution?
