Ran across an interesting senerio.
California requires the same filing status as filed on the federal return.
Here is the senario, any other comments are very welcome.
Tax payer has a 31 year old son living with him full time, son did not earn any money in 2005, however he did receive $5,000 dollars of unemployment income from CA.
According to IRS & TTB 3-16 last senario taxpayer is not qualified to claim HOH filing status or claim the child as a dependent due to to much taxable income.
HOWEVER, CA does not tax un-employment income and as a result his son has no CA income and it seem to me the taxpayer could file HOH. (yes the taxpayer pays more than 1/2 the cost of keeping up the home)
Am I thinking right on this?????
