    Are there any situations where a SS# starting with 9 can be employed?

          OK! Here is the story! With ITIN THEY CAN WORK but the social security withheld goes into a holding account that the worker never gets credit for and will never be able to collect SS. They must file a tax return and pay taxes like everyone else.

                The ITIN itself does NOT allow a person to be employed. They need some kind of authorization. See page two of the I-9 for the documentation that an employer needs in order to hire somebody.




                But you are asking on a tax forum, not a Department of Labor forum. From a tax perspective, yes, they file a tax return whether they are legally employed or illegally employed.

                  Employers are not stopped from hiring workers with ITIN. The worker just does not get SS and MEDICARE credit. All info published from U.S government says do not hire, but if hired the only consequence is to the worker.

                      So these "illegals"you previously referenced are the employers who flout the law.

                      Your original question Are there any situations where a SS# starting with 9 can be employed? We all presume you mean legally - correct? Here is what our friends at 1111 Constitution Ave say:

                      Employee's Social Security Number (SSN)

                      You are required to get each employee's name and Social Security number (SSN) and to enter them on Form W-2 (this requirement also applies to resident and nonresident alien employees). If your employee does not have their social security card readily available, then the Social Security Administration (SSA) offers
                      Social Security number (SSN) verification and quick access to relevant forms and publications.

                      Do not accept an ITIN in place of an SSN for employee identification or for work. An ITIN is only available to resident and nonresident aliens who are not eligible for U.S. employment and need identification for other tax purposes. You can identify an ITIN because it is a 9-digit number that begins with the number "9" and is formatted like an SSN (NNN-NN-NNN).

                      Note: An individual with an ITIN who later becomes eligible to work in the United States must obtain an SSN.

                        I know about the official requirements to work and then there is what's happening in the real world. They are being paid on a w2 and filing tax returns.
