    Convert from Partnership to S corporation

    Can I convert a Partnership 1065, who now a single member, to an S corporation...I have looked at the tax book for assistance but can find no information on this item...Thanks,,Duane Anderson

    If it's an LLC taxed as a Partnership, see form 8832 to see if they can change tax status to taxed as a S corp.

    If they are not already a LLC, then they need to file paperwork with state to become either a LLC or Corporation, then choose to be taxed as a S corp. New company would then need to purchase the assets of the Partnership.

      The existing LLC would file form 2553, to elect to be taxed as an S-Corp. Form 8832 would be used if electing to be taxed as C-Corp. Must be filed by 3/15 of new calendar year.

        Can't have a single member 1065. Was he in a partnership that members left, and he is now the only member remaining?
