    OIH Question & Black Bart

    Client has a legitimate office in home. My question is:
    Are part of trash pickup expense and Home Owners Assoc. dues considered
    to be part of home office expense?
    Another unrelated question: Where is Black Bart with his philosophical wisdom?

    It would not even occur to me to question these charges as OIH expenses. I have been wrong before though.

      ordinary and necessary business expense

      Generally trash pickup is deductible if it relates to the business use as well as the personal use. If it's for construction debris from building the swimming pool, maybe not.

      Homeowners fees are often a collection of different expenses. The first question might be, does the homeowner's association allow a business to operate out of the home, because that would make it hard to claim a business purpose for it! Some fees are actually assessments for capital assets such as the new clubhouse, which might also not be an ordinary and necessary business expense.

        I would definately take the trash as an expense, but would check into the HOA dues as Jainen has said.

        As for BB I was wondering the same thing, I have missed his stories lately. maybe he was to tied up with S-corp and C-corp returns.

          Black Bart Hiatus

          Sometimes Black Bart takes a hiatus. Like many of us he has a life after tax season and often lets his fingers rest. Besides, the Razorbacks won in Nashville the other day.

          It always takes the zing out of the message board when he takes a sabbatical. When he returns, sometimes he comes back with a vengeance, reading 60 days' worth of posts and responding to them.

          Never fear, Black Bart will Reappear!

              Chicken & Egg Syndrome

              Bird Legs, you're on the right track. Trouble and Black Bart follow each other.

                      jainen- Question- If I said the sky was infact blue would you argue that it was actually red? It apprears to me that you enjoy playing devil's advocate to the point of disagreeing even if you infact agree.

                            Actually, the sky has no color. The blue you see is the short wave length of blue light that bounces off the sky because it is too short to penetrate through into space...or something like that...
