    Earned Income Credit

    Taxpayer is 21 years with earned income from part time jobs of 8,000. Wants to file return separately in 2021. Can he claim the earned income credit if he is not claimed as dependent on parents tax return. Tax software is denying credit as he needs to be at least 24 years

    If he's a student and therefore presumably a QC, he needs to be 24 to claim EIC. If he's not a student something may be checked incorrectly on your software.

      He is claiming the education credit which shows that he was at least a part time student (took 9 credits). Does he qualify for the EIC in this situation

        Is he a qualifying child? That is the question YOU need to answer.

          If he was at least a 1/2 time student, he does not get EIC at age 21.

            As Kathy noted, if he (a) is at least a half-time student, (b) working on a certificate, degree, etc., (c) at a eligible educational institution,he does not qualify for EIC because he is under age 24.
