Divorced Parents Advanced child Tax Credit.

The father claimed the child in 2020. He is the non-custodial patent. He received the Advanced Child Credit, in 2021. He gave the money to his ex-wife, but he received the IRS letter about receiving the $1,500 Advanced Child Credit.

Whose tax return do you report the Advanced Child Tax Credit on and will the father have to pay the money back to the IRS.

    Thank you.

Report on Father (Irrelevant where the money went). If his income is above the safe harbor, he will have to pay it back.

So the mother will receive $3,000 Child Tax Credit when she does her taxes because she did not get the money from the IRS during the year? So basically the IRS passed out $4,500 to this family?

CONGRESS passed out the money - the IRS simply administers the law created by the gang of 535.
