    truckers and per diem

    I haven't had to deal with a truckers per diem for several years. And now that form 2106 is limited. any suggestions on how to report the per diem? I have looked in my Drake manual and called them. Didn't give me any info except "2106 is no longer used". Any advice greatly appreciated!

    Is the trucker an employee? If so, there is no deduction for Federal taxes, so you don't need to do anything (unless your State allows it).

    Or is your trucker an Independent Contractor?

      I understand the argument employee vs owner operator. I guess I'm confused because in TTB tab 3 page 5 "Special rules for transportation workers" it doesn't really specify which or where. I have contacts in the industry , none of whom seem to agree on the issue. Some companies pay an extra dime or so per mile that is not taxed--others do not. My client receives ten cents less per mile that others. He's a senior driver with lots of miles so I don't think it's a matter of seniority or experience. Kind of a head scratcher...

        Its not really a head scratcher...

        W2 - no deductions for anything since 2018
        1099M - deduct all expenses including per diem
