    Florida Qualified Disability trust?

    Florida Qualified Disability Trust - does it become a Minnesota Qualified Disability Trust by moving?

    Set up by Father years ago - she is in her 70s has lived in FL for years (where Father had and brother lives) when Dad dies some money goes into to trust her sister is trustee, and sister and brother are to inherit if she dies with anything still in trust. 2020 beneficiary moves from FL to MN where trustee sister lives. Beneficiary years ago was on SS disability, FL attorney had set this trust up as Qualified Disability Trust - now in MN. Beneficiary will file as MN resident, trustee is MN resident does trust now become a MN trust????

    Might be best to get attorney advice since it may/may not be a legal issue

      Generally, trusts established in one state are valid in other states and can be transferred. Its a good idea for an attorney in new state to review these, as there may be quirky laws in original state that may not be compatible. Also at the same time, have him/her review any old wills for updates.
