The executor's commjission on an estate is taxable income and I'm quite sure it is reported by the estate on 1099-MISC and I believe it is reported in box 3 because it is not subject to self employment tax, box 7, unless the recipient is in the business of being an executor, which my client is not. After much research I cannot find specifically that it is reported on box 3, or elsewhere, of the 1099-MISC. Looking for comments. Thank you.

According to this article--No 1099-Misc is required to be file.

I haven't prepared an estate tax return in a long time. Is the estate in a trade or business? If not, perhaps it has no 1099-MISC reporting requirement.
Any one, any entity, CAN report via Form 1099-MISC. But, if it does, I don't think it's the estate's job to determine if the executor is or is not in the trade or business of being an executor.
