    Divorce settlements *******my ex wife handled me a check*************

    I was marries in 1981
    purchased a house with my wife..(ex wife now)
    on 1990 i was asked by my wife to leave the house.
    I still live outside the house supporting the house and the three children.
    On november 05/2005 i went to court and my divorce was finalized.
    The house was to be sold and split 50/50 after all kids were emancipated,,, this never happen,,,
    i have not lived in the house since 2005.
    On april 05/2019 the house was sold to my ex wife.
    I was bought out for my ex wife. She gave me a check of $105,000.00
    the fmv of the house now is $ 373,000.00
    i gave my elderly mother $10000 as a gift for her daily living expenses
    my questions are:
    Can i exclude this money for a first time home buyer?
    Do i have to pay tax on this money if so, how can i reported on my taxes?
    .can i take off some expenses?
    Now, i am married again and i own an other house with my second wife.

      Follow Lion's suggestion but basically this is the exception that you may be looking for:

      Separated or divorced taxpayers

      If you were separated or divorced prior to the sale of the home, you can treat the home as your residence if:
      • You are a sole or joint owner, and
      • Your spouse or former spouse is allowed to live in the home under a divorce or separation agreement and uses the home as his or her main home.
      If your home was transferred to you by a spouse or ex-spouse (whether in connection with a divorce or not), you can count any time when your spouse owned the home as time when you owned it. However, you must meet the residence requirement on your own.
