On taxpayer's W-2 under misc non taxable is listed amount received as non taxable compensation. However the employee received another W-2 in the exact same amount listed as wages and marked as sick pay from the 3rd party insurance company. FICA and Medicare were deducted from these payment. No income was deducted. Are these payments taxable.

First to make sure how much he actually received , have him pull out the deposit or paycheck voucher for year end.
You will find that the W2 with Third Party Sick pay is taxable just like any regular paycheck W2.Taxes after all are the dues that we pay for the privileges of membership in an organized society. - FDR
