    State Tax Credits

    Married couple filing joint federal
    Man full year RI resident
Woman 3/4 year NY resident and 1/4 year RI resident. .
Ri says you file same as Federal which is joint, full year residents
NY says can file MFS or MFJ. They pay less tax doing it MFJ.
I did full year resident MFJ on both states.
Then I took a tax credit from NY to RI which wiped out the RI tax. As there is a zero RI tax there is no tax credit from RI to NY.
.Anyone have any opinion on my technique.

I believe RI has similar definition of who is a resident and it has to exceed 182 days. So technically the wife is a non resident of RI.

I would have filed part year resident for RI.

I think ATSMAN is correct. A joint return for RI is an option but given your facts the taxpayers could have also filed separate returns.

Sorry, I was not clear enough. I am looking for feedback on claiming a tax credit from a full year resident NY return to a RI full year resident return. I have only claimed tax credits from non residents returns. Also the RI instructions state MFS only allowed if one a resident and one a non resident.when file Federal MFJ
