    Premium Tax credit Form 8962

    We have a husband and wife situation. Wife has insurance through market place and receives the advance payment of PTC. Husband has own insurance through his union. Can the wife file as married filing separately?

    Wife can always file as MFS. But, MFS doesn't qualify for any APTC (does she?), so she'll have to pay it all back. Does she qualify for any cap on her repayment, due to low income or whatever?

      I found the answer to my question in Tax Book Page 11-13. If spouse received APTC she and her husband must file MFJ.
