    Guardianship and Dependent

    Client has received guardianship for one of the children from an unrelated person due to this person being in prison. This was not done through an agency but through a notarized POA. The second child of the same person was in the foster care system and my client has an letter from the agency awarding this foster child to her. Both documents were signed in February 2018.

    I believe they can only claim the foster child since the other child for which they have guardianship didn't live with them for the full year. Anyone disagree?

    Agreed for the non foster care child.

    How long did the foster child live with?

      Provided the incarcerated parent did not earn enough income in 2018 to file and the other parent is not in the picture they can claim the non foster as an other dependent (if the residency and income qualifications are met)

        OP already said non foster care child didnt live with all year.
